Telcan Inc. reserves the right to restrict internet usage in the event that a customers’ internet usage is so excessive that it impacts the network capacity and our ability to provide service to other users.
Flat rate or unlimited use plans and services offered are subject to the customer using the service under an ordinary range of use and in a way that does not consume excessive network capacity and/or adversely affects Telcan’s ability to provide services to other users. By way of example and not limitation, the following are considered by Telcan Inc. to be outside of an ordinary range of use thereby consuming excessive network capacity:
Telcan Inc. may immediately suspend, restrict, alter or terminate all or part of any service provided to a customer or take other necessary protective measures, if it determines that a customer is violating this policy, as determined by Telcan Inc., acting reasonably.
Telcan Canada has developed this Fair Usage Policy as a guide and reference for its customers to understand the intended uses of our service, and to prevent fraud, and abuse of its unlimited calling plans and features. This Policy is based upon the Terms of Service and is applicable to all services provided by Telcan.
Telcan home phone service is for single-family residential use only and cannot be used for commercial purposes. It is designed for our typical residential customers' calling patterns simulating normal residential use.
Telcan’s residential unlimited service plans and features are only for single and not multi-family residential. Residential family members include your immediate family who reside in your personal residence - e.g., spouse, domestic partner, parents and/or children.
Telcan evaluates customer usage in comparison to typical levels of permissible usage engaged in by legitimate residential customers. Telcan does not allow the use of phone by or for others who do not live with you. Operating a business, even if operating from the residence, operating any other enterprise, including not-for-profit or governmental, operating a call center, resale to others, auto-dialling or fax/voice telemarketing, without live dialogue, including use as a monitor, intercom or for transcription purposes
Telcan residential unlimited calling plan customers use less than 3000 minutes per month and do not have any unusual usage patterns in terms of unique numbers called, high call forwarding/transferring usage and so on. A customers' usage may be considered outside of normal use if it exceeds 3000 minutes per month or any other abnormal calling patterns indicative of an attempt to evade enforcement of this Fair
Based on the above, Telcan may determine that abnormal, unreasonable or impermissible usage is occurring when compared to typical customers on the same calling plan, and may take appropriate steps described below to enforce this Policy.
Telcan may also determine that abnormal, unreasonable usage is occurring, and may take appropriate steps described below even if the number of minutes used is not excessive.
You agree that you will not use Telcan’s service or devices in any way that is illegal, fraudulent, improper or inappropriate. You may not use any automated means to manipulate our service or use our service to violate any law, rule, regulation or any third party's intellectual property or personal rights.
We reserve the right to review your account and take further action, including, but not limited to, immediate suspension of your service If we believe that our service has been used for an unlawful purpose, we may immediately terminate your service with or without notice and/or forward the relevant communication and other information to the appropriate authorities for investigation and prosecution. We reserve all of our legal rights.
Telcan reserves the right to change this Policy at any time. Changes shall become effective as soon as the revised Policy is posted to Telcan’s websites.
